Whiz Comics (Volume 1) with a cover date of March, 1940.
Synopsis for "Sivana Strikes Again!"
Sivana sends a letter to the President of America ordering him to turn the country over. When this is not even answered he tries to invade America with an army using advanced weaponry. Captain Marvel fights of the men. He gets on a plane heading to Sivana's' castle. He defeats Sivana's General. However he is gassed and chained, coming to in Sivana's office. Sivana reveals his atom-smasher, which will go off in five minutes. However his army returns, angry at being defeated. Cap breaks free and leaps out of a window, soon after the castle is destroyed by the atom-smasher. He turns back to Billy Batson and reports Sivana is dead by his own hand.
